Warning about fraudulent payment requests
Fraudulent payment demands have recently been going around, sent by letter on name of International Inkasso GmbH.
The return address listed on the letters is Steindamm 71, 20099 Hamburg, or P.O. Box 20085. Only companies belonging to the EOS Group, including EOS Deutscher Inkasso-Dienst GmbH, are headquartered at Steindamm 71, 20099 Hamburg, or P.O. Box 20085, Hamburg. A company named “International Inkasso GmbH” is neither affiliated with nor known to the EOS Group.
You do not need to notify us separately if you have received such a letter. We regret that you have been the target of such a fraudulent attempt and are taking legal action against the senders of these fraudulent letters.
All about debt collection
You have purchased a product or used a service and have not paid the outstanding amount, or have not paid it in full, despite payment reminders.
Your contracting partner then has the option to assign the outstanding debt to CREDITABLE OPPORTUNITIES FUND II SCS-RAIF DE-SF 1.
CREDITABLE OPPORTUNITIES FUND II SCS-RAIF DE-SF 1 will then become the new creditor and payee.
We may subsequently be commissioned to handle the outstanding debt. We will then be your point of contact for any questions.
A debt exists if you do not pay an invoice or installment, or if you do not pay it in full. In that case, the company is entitled to demand payment of the outstanding amount from you.
We are engaged when the outstanding payment remains unpaid despite a payment reminder. We will then contact you to work with you to find a solution for settling the outstanding debt.
Every claim at EOS has its own 11-digit claim number. You’ll find this number in the top right corner of the letter you received from us.
You’ll need the claim number, for example:
By providing your claim number, we ensure that payments—such as bank transfers—can be quickly and accurately assigned.
For this reason, please always include the 11-digit claim number in the payment reference.
The principal claim is the amount stated on your original invoice or for the service rendered. In addition, there is what is known as an ancillary claim. The ancillary claim consists, for example, of collection costs and interest. In addition to collection costs and interest, the ancillary claim may increase due to costs associated with, for example, address verification or court-ordered collection proceedings.
Sometimes there is a mix-up regarding a person’s identity. For example, if the person in question has moved and has not officially updated their address. In that case, our mail does not reach them, so we request an address trace.
In doing so, the service provider or the Residents’ Registration Office may provide us with the address of another person with the same name.

This also applies in cases of suspected fraud: If you suspect that your identity has been misused and someone has placed an order or entered into a contract in your name.
The original transaction is the contract that started it all. The original transaction gives rise to a payment that you are required to make—such as an installment or an invoice.
For example, let’s say you ordered something from Otto. Otto is then your original creditor. Your order is then the original transaction.
The statute of limitations is like an “expiration date” for claims. Claims generally expire after three years. For consumer loans, the three-year period does not begin until 10 years have passed. Claims that have been enforced through a court judgment expire after 30 years.
Please note that the statute of limitations may change under certain conditions.
Payment service providers are companies that facilitate payments through technical means. Well-known payment service providers include Klara, PayPal, Rate Pay, and Otto Payments.
For example, if you want to place an order with Otto, you have the option to pay via Otto Payments. In this case, Otto Payments is the payment service provider.
In such cases, you owe the outstanding amount to Otto Payments, not to Otto.
About Your Payment
The payment due date is the date by which the funds must be in our account. Please note that a bank transfer may take several business days to process. If you wait until the due date to make the payment, the funds often arrive too late. In that case, the payment will be considered overdue.
To avoid this, we recommend that you make the payment well in advance.
In some cases, we will agree with you to settle the debt. This means that we will not charge any further interest or fees on the outstanding amount. Depending on your financial and personal situation, we will agree on a specific amount (known as a settlement). You can then pay this amount in a single lump sum or in monthly installments. Once the settlement is paid in full, the debt is considered paid off.
With direct debit, you authorize us to withdraw a specific amount of money from your account. For example, an installment payment. If we are unable to process a payment—for instance, because there are insufficient funds in your account—this results in what is known as a chargeback. This chargeback incurs bank fees.

Debt collection costs
If we are unable to reach you at the address we have on file, we will initiate an address search. To do this, we will engage a service provider. This provider will determine your current address so that we can contact you. Or we will ask the local registration office for your current address.
An address search incurs costs. To avoid these costs, please always notify us in a timely manner if you have moved or if your contact information has changed. Please use our online contact form for this purpose.
The settlement fee is a fee set by law. It becomes due when we reach an agreement with you on a solution for your outstanding invoice. This is the case, for example, when we agree to a payment plan with you. This agreement is reached directly between us, without the involvement of a court
When we are retained, costs are incurred. These include, for example, collection fees, interest, reminder fees, telephone and postage costs. Costs associated with locating an address are also included in the collection costs.
We are permitted to bill you for these collection costs as damages for delay.
In Germany, collection fees are governed by the Legal Services Act, and the amount is determined in accordance with the Lawyers’ Fees Act.
Court dunning and enforcement
If you have not yet paid the outstanding amount despite our payment requests, we may initiate court collection proceedings.
To do so, we will first apply to the court for a payment order. Once you receive the payment order, you have two weeks to pay the full amount owed. If you do so, the court collection proceedings will be concluded.
If the debt is not paid in full or if you do not file a valid objection, we will then apply to the court for an enforcement order. The enforcement order is also referred to as a title. Once issued, the debt becomes enforceable.
For enforceable debts, we have the option of initiating enforcement measures. These include, for example, bank account garnishments or wage garnishments.
If there is a titled claim, we can engage a court bailiff. The bailiff may, for example, request a statement of assets from you or carry out a garnishment.
An account garnishment is a legal step. It ensures that the outstanding debt is paid. Your claim was already recognized by a court prior to the account garnishment. Your claim is therefore titled.
For you, this means: Your bank is no longer allowed to pay you any money up to the amount subject to garnishment. Transfers and standing orders are also no longer possible. Your account and your bank cards will be blocked during this time. This remains in effect until the garnished amount is paid.
A salary garnishment is a legal measure. It ensures that the outstanding debt is paid. Your claim has already been recognized by a court prior to the salary garnishment. Your claim is therefore titled.
What this means for you: Your employer will then transfer a part of your salary directly to us.
Important: Not your entire salary will be garnished. A certain amount will always remain with you. This amount is intended to cover your living expenses and is called the “garnishment exemption.”
A payment order is an official letter you receive from the court. If you have received a payment order, the court collection proceedings are already ongoing. We initiate these proceedings if the debt remains unpaid and we have been unable to reach a solution together.
If you still don't pay the outstanding amount despite our payment requests, we will initiate a court-ordered collection procedure. This may ultimately result in a so-called enforceable judgment, such as a writ of execution. The debt will then be titled.
With an enforceable judgment, we may demand payment of the titled outstanding amount from you for up to 30 years. In addition, further enforcement measures may follow, such as a garnishment.
Submitting a financial disclosure statement is a legal enforcement step. In the financial disclosure statement, you provide information about your financial situation. For example, how much you get paid, whether you own a house or a car.
You are required to provide truthful answers to these questions.
